View Full Version : **long rant** i hate alpha construction

I was out of town on business from thursday until sunday, on sunday my business partner has the bright idea of going to the airport at 130 for our 650 flight, hoping we can get on a earlier flight, of course, no go. anyways sitting in NYC for 6 hours plus 2.5 hour flight and then had to drop him off at home, by the end of all this, all i want to do is get home. i get about 2 minutes from my house when BOOM!!!! i drive over a F'n trench across the entire road:

now mind you, these pictures are taken the next day *AFTER* they fill it back up with gravel.

One of my $250 (passanger front) tires blows out, i change it by the side of the road, have to pull out all stereo equipment first of course, change the tire go home and decide to deal with it in the morning.

The next morning i take a closer look around and realize that i have THREE bent rims (yellow tire crayon highlights bends)and the underside of my front bumber is scrapped up :

at this point im FURIOUS beyond all logical thinking, i drive in to the village hall to complain, they tell me i have to go talk to construction company, i go to the job site, they tell me i have to go to their headquarters. When i finally arrive i let the secratary know that i need to speak to managment and my reason why, and she walks around the corner... now heres the kicker... the "boss" says "That kid is full of shit, he was probally driving like a manic! take down his number and throw it away!!" i step around the corner and say "exuse me sir, wanna tell me to my face im full of shit!" at this point he looks like he just saw a ghost! then after several minutes of arguing and him telling me im lying and that it is MY FAULT for having low profile tires! The guy turns his back to me and walks 25 feet across the room. i take a business card and let him know that i will not be going away!

I call my lawyer and detail him on the situation he tells me to get estimates for EVERYTHING and file a police report. The Police station lets me know that several people have filed reports. Under the advice of my lawyer i wrote them a letter giving them until Thursday to repsond. this letter was inculded with pictures of everything, $1,736.55 in estimates, and a copy of the police report. If they call and try to "settle" im telling them, "consider $1,736 a settlement becuase im not adding lawyer fees!!!"

so sadly, back to stock rims:

i REFUSE to settle with this comapny, when i first when in their i asked for 500-600 in damage payment, he insults me, calls me a liar, and even goes so far to accuse me of working with another man who came in and had damages to his car as a result of the same trench.

well, i feel better venting to everyone. let me know what you think

That sucks. I hate people like that. At least you will be able to get the money for the damages, but it's such a hassle.

Ouch.. that sucks big time. I've hit trenches before, but I never blew my tires.

Don't settle out of court unless its much much more than you expected. I hope that @sshole construction manager gets whats comming to him:mad:

Just keep us posted on what happens.

If you go to court don't forget you had to take time out of work and add that on the bill, but LsVtecStolen has his head up his *** if he thinks you're going to get more than $2,500 or so (depending on your salary, of course). Also you should get a full inspection of the undercarriage and suspension just to make sure nothing is cracked/damaged.

Take his ass to small claims court. Because he could of settled this when you went their, but since he didnt you should nab his ass for lawyers fees, and all.

the only reason im avoiding that, is because a $500 retainer, that *MIGHT* get rembursed.

but, if it comes down to it... ive let my lawyer know that his time to me is worth thousands per hour!!!:D

nail em to the wall on this one. It would be one thing if they were decent about it but this guy was just an asshole. Get everything you can out of em!

I heard of a case like that a long time ago...and I think it was Detroit where a car was damaged due to city road constructions, owner sued and won his case...don't know what the payoff was though. Good luck to you in your situation...it looked like a painful experience, bending 3 rims in one shot...

Btw, what kind of rims are those anyway?

It really sucked that it happened to you, and sure you should pursue legal action against "negligent" construction company. You have to get pictures and testimonies that there were no warning signs 100 to 50 feet from the trench, depending on the DMV code in Illinois. Also, small claims courts are "people's courts" where you don't need a lawyer, $10-$15 filing fee is what's required. In most states small claims courts WILL NOT reimburse you for lost wages or lawyers. Most small claims courts have $3000-$3500 limit, anything over that needs to be filed in Civil court and may take years.

Your best approach is to subpoena the construction company to give you the name of the other individual who complained. Polica may also help you locate other people. Then you can pursue a class action suit and get "pain and suffering"

Dude I feel for ya, I live in Hopatcong, NJ. They are putting in Seweres, and for some reason they feel that Paving is overrated. My girl blew out a tire on her Jeep Grand Cherokee on one of those metal plates they lay down over the road. Call the town and fill out a complaint, they will settle this in small claims court.

Let them pay for it!

Maybe I missed it but what kind of rims do you have. They look like they bent pretty badly.

one rim is bent bad, but the other two have very minor bends.

they are damaged rims, i know this. thats why i said make me an offer, if you look above, you'll read someone else saying that because they are steel, they *could* be bent back. they still wont ride perfect, and youll hae to be extra careful on pot holes and train tracks, but thats the deal.

sorry for no update, but they paid me *most* of what i asked for!

so it worked out well, and i have decided im going to keep stock rims on for atleast awhile.

thats why im selling bent rims.
